Law Practice

Sam W. Maynes is a partner in the law firm of Maynes, Bradford, Shipps & Sheftel, LLP. His practice is limited primarily to representation of the Southern Ute Indian Tribe, concentrating mainly on environmental matters, intergovernmental relations, treaty rights, taxation, and jurisdictional and regulatory issues. His practice includes the representation of the Tribe in all aspects of federal Indian law. Over his 20 year career, Sam has litigated administrative hearings, conducted several trials, and appeared in federal and state appeals. He also has been involved in the training of attorneys to join the Tribe's in-house legal department.

The focus of Sam's recent practice is at the intersection of environmental law and Indian law where his is a member of both the air quality and water quality teams for the Tribe. that capacity, he is assisting in the drafting of air pollution control regulations and water quality standards for the Southern Ute Indian Reservation, frequently interacting with U.S. Environmental Protection Agency and State of Colorado officials.

Education

Sam received his undergraduate degree from Fort Lewis College in 1985, and his law degree from the University of Colorado in 1988.

  • Representative Experience

  • Represented the Southern Ute Indian Tribe in successfully enjoining the continued discharge of water pollutants into the Tribe's drinking water source, in violation of the Clean Water Act, by an upstream off-Reservation municipal wastewater treatment facility.
  • Represents the Southern Ute Indian Tribe in the development of air pollution control programs for the Southern Ute Indian Reservation. This involves extensive work with Tribe's Environmental Programs Division; the Southern Ute Indian Tribe/State of Colorado Environmental Commission; the U.S. Environmental Protection Agency; and the State of Colorado Air Pollution Control Division.
  • Represented the Southern Ute Indian Tribe in the negotiation of several intergovernmental agreements with federal, state and local governments and was one of the principal drafters of the Intergovernmental Agreement between the Southern Ute Indian Tribe and the State of Colorado Concerning Air Quality Control on the Southern Ute Indian Reservation (1999); the Intergovernmental Agreement Concerning Revocation of Drivers' Licenses (2001); and the Memorandum of Understanding Between the Southern Ute Indian Tribe and State of Colorado Concerning Wildlife Management and Enforcement in the Brunot Area (2008).
  • Lead plaintiff's counsel in actions for damages for breach of contract involving the conduct of a motorcycle rally. These actions in Tribal and State court resulted in favorable judgments for the Tribe.
